1. Acceptance of terms

By creating an account, accessing, or using the EquiTrack web application, APIs, or associated services (collectively, the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and the Privacy policy.

If you are entering into these Terms on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms. If you do not agree with any part of these Terms, you must immediately terminate your use of the Service.

EquiTrack reserves the right to modify or update these Terms at any time. When updates are published, the “Last updated” date at the top of this page will be revised accordingly. Your continued use of the Service after any modification constitutes your acceptance of the updated Terms.

2. Nature of service & non-custodial tracking

EquiTrack is a non-custodial financial analytical tracking platform. The Service allows users to record, aggregate, and analyze personal investment portfolios, transaction ledgers, performance metrics, and corporate action events.

Important service boundaries:

  • EquiTrack is not a bank, broker-dealer, investment advisor, or custodian.
  • EquiTrack never holds, accepts, transfers, or takes custody of your cash, securities, or digital assets.
  • EquiTrack does not execute securities transactions or place trades on your behalf.

3. No financial, tax, or investment advice

The Service, including all calculations, valuations, DCF models, CAGR metrics, dividend schedules, and performance figures, is provided strictly for educational and informational purposes.

Nothing on EquiTrack constitutes financial, investment, legal, tax, or accounting advice. EquiTrack does not recommend, endorse, or solicit the purchase or sale of any security, mutual fund, ETF, cryptocurrency, or investment instrument.

You acknowledge that all investment decisions involve risk, including the possible loss of principal. You are solely responsible for evaluating the merits and risks associated with your investment activities and should consult an independent certified financial advisor or tax professional before making financial decisions.

4. Account registration & security

To use the Service, you must create an account using a valid email address or authenticated third-party identity provider (such as Google Sign-In). You must be at least 18 years old or the age of legal majority in your jurisdiction to register an account.

You are responsible for maintaining the confidentiality of your credentials and multi-factor authentication tokens. You agree to notify EquiTrack immediately at support@equitracking.com if you suspect unauthorized access to your account.

5. Subscriptions, billing & cancellation

EquiTrack offers access to the Service through free tiers as well as optional paid subscription plans that may be made available from time to time.

  • Free Access: Where the Service or any specific feature is provided free of charge, no subscription fees apply.
  • Paid Subscriptions: If you elect to purchase a paid subscription tier or feature add-on, you agree to pay the recurring subscription fees specified at the time of purchase. Paid subscriptions automatically renew at the beginning of each billing interval (monthly or annually) unless canceled prior to the renewal date.
  • Cancellation Anytime: You may cancel any paid subscription at any time directly through your account billing settings. Upon cancellation, your subscription remains active with full tier access until the conclusion of your current paid billing period.
  • Fee Modifications: EquiTrack reserves the right to modify subscription pricing upon reasonable advance notice. Price adjustments apply only to subsequent billing cycles following notification.

6. User data & intellectual property

You own all rights, title, and interest in your personal financial data. EquiTrack claims zero intellectual property or ownership rights over the portfolios, transactions, notes, or holdings you record within the Service.

You grant EquiTrack a limited, non-exclusive, worldwide license to host, store, and process your data solely for the purpose of providing, maintaining, and improving the Service for you. As detailed in the Privacy policy, EquiTrack does not monetize, sell, or license your portfolio data to third parties, hedge funds, or advertisers.

All software, algorithms, UI designs, trademarks, logos, and documentation provided by EquiTrack remain the exclusive property of EquiTrack and its licensors.

All third-party company names, logos, stock tickers, and trademarks referenced on the Service are the property of their respective owners. Their display on EquiTrack is solely for identification purposes and does not imply any affiliation, sponsorship, or endorsement.

7. Market data accuracy & service availability

EquiTrack sources market data, pricing quotes, historical dividends, and corporate action events from third-party market data providers and public regulatory disclosures. Third-party data feeds may occasionally be delayed, inaccurate, or temporarily unavailable.

Market data feeds, stock quotes, and foreign exchange rates may be delayed by 15 minutes or more or reflect end-of-day closing prices in accordance with exchange provider policies. EquiTrack is not liable for quote delays, feed interruptions, or transmission lags.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. EquiTrack does not warrant that the Service will be uninterrupted, error-free, or entirely free of inaccuracies.

8. Acceptable use policy

You agree not to:

  • Reverse engineer, decompile, or disassemble any aspect of the Service;
  • Scrape, crawl, or harvest data through automated means or unauthorized bots;
  • Interfere with, disrupt, or place an excessive load on the infrastructure of the Service or related networks;
  • Attempt to bypass rate limits, authentication barriers, or security controls;
  • Use the Service for any unlawful purpose or in violation of applicable securities laws.

9. Termination & account deletion

You may terminate your account and delete your data at any time directly through your account settings or by requesting deletion via support@equitracking.com. Upon account deletion, all personal data and associated portfolios are permanently erased in accordance with the Privacy policy.

EquiTrack reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or jeopardize platform security, with or without prior notice.

10. Limitation of liability & disclaimer

To the maximum extent permitted by applicable law, EquiTrack and its officers, directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages—including trading losses, capital losses, or data loss—arising out of or related to your use of the Service.

In no event will EquiTrack’s total aggregate liability arising out of or related to these Terms exceed the greater of the fees paid by you to EquiTrack in the twelve (12) months prior to the claim, or one hundred euros (€100.00 EUR).

11. Governing law & contact information

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands. If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of your country of residence.
